BlackBerry From Optus BlackBerry Internet Solution (BIS) Service Employee Plan

  1. The Service is referred to as the BlackBerry® From Optus BIS Service. BlackBerry and RIM are registered trademarks of Research In Motion Limited (RIM) and are used by Optus with the permission of RIM.
  2. To operate the BlackBerry From Optus Service, customers are required to connect to a BlackBerry From Optus Service rate plan and use a GPRS and BlackBerry capable device. A BlackBerry capable device is a RIM manufactured terminal or a mobile phone equipped with modules of BlackBerry Software.
  3. The Service is only available to current Optus Mobile Digital postpaid customers who Optus classifies as employees of Optus Corporate customers within Australia connected to a BlackBerry From Optus BIS Service rate plan and using BlackBerry capable devices.
  4. It is not available to Optus Mobile CDMA customers, Optus Pre-Paid customers or Optus MobileSat services.
  5. To the extent permitted by law, Optus excludes all liability for and is not responsible for: (a) any problems or technical malfunction of any technical network or lines, computer on-line systems, servers, computer equipment, mobile devices, software, technical problems or traffic congestion on the Public Internet or at any website or on any email system or any combination of these, including any injury or damage to the customer's or any other person's computer or mobile device related to or resulting from the use or attempted use of the Service; or (b) loss of data resulting from the use or attempted use of the Service; (c) the customer indemnifies Optus against all loss, damages, costs or expenses suffered or incurred by Optus, (including costs on a full indemnity basis) directly or indirectly, arising from or relating to the use or attempted use of the Service.
  6. Compatible devices are required for use of the Service and Customers are responsible for determining if devices are fit for their intended purpose.
  7. The Service in whole or part may be suspended, changed or terminated at any time without notice.
  8. Customer traffic and usage information is held on databases provided and operated by RIM.
  9. Software supplied to use the BlackBerry From Optus BIS Service is produced by RIM. Optus is not responsible for and does not warrant the performance, interoperability, stability and/or safety of any software or network supplied as part of the Service.
  10. Customers are required to accept an End User Licence Agreement (EULA) when installing software on their Computer to access the Service. Customers are responsible for: (a) determining whether their information technology and communications systems and wireless devices are compatible with the Service, and (b) ensuring compliance with all terms and policies (including security and email policies) that apply to the information technology, and (c) communications systems used by the customer and the email account to be used in relation to the Service, and (d) notifying Optus if the customer chooses not to agree to the terms of the EULA, and (e) as the BlackBerry device includes encryption software that is subject to domestic and foreign legal restrictions that restrict export, import and use of the device and associated software, the Customer or end user is not permitted to roam to any country with the BlackBerry device where such restrictions apply. It is the Customer's/end user's responsibility to familiarise themselves with any such restrictions which may impact the Customer's/end-user's ability to roam with the BlackBerry device. The fact that Optus may have a roaming agreement with a foreign jurisdiction does not mean that the Customer/end-user may roam to that foreign jurisdiction with the BlackBerry device.
  11. The Customer must comply with Optus' policies concerning abuse of email systems and comply with any Commonwealth or State laws concerning abuse of email systems.
  12. Optus may modify terms and conditions at any time without notice. The customer's continued use of the Service will constitute acceptance by the customer of any modification to these terms and conditions.

BlackBerry from Optus Pricing

  1. BlackBerry From Optus pricing applies to a standard BlackBerry From Optus deployment. Optus reserves the right to quote for a non-standard requirement.
  2. The Service is billed to the Customer's Optus Mobile Digital phone account. The charge for access to the Service is an ongoing monthly charge, billed in advance, until cancelled.
  3. Unlimited Plans: Minimum total cost of the $38 monthly email plan over 24 months is $912 or of the $40 monthly email plan over 12 months is $480, providing users with unlimited email usage on BlackBerry from optus BIS Service.
    1MB Plans:
    Minimum total cost of the $25 monthly email plan over 24 months is $600 or of the $27 monthly email plan over 12 months is $324, providing users with up to 1MB of email usage on the BlackBerry from Optus BIS Service.
    All Plans:
    International GPRS roaming charges are excluded from the Monthly Email Fee and will be charged separately at standard GPRS roaming rates. Non-email traffic such as voice, SMS, WAP, MMS and other data will be billed at the applicable rate set out in the standard agreement.
  4. The minimum commitment for use of the BlackBerry From Optus Service is 12 or 24 months. Cancellation fees are applied if the Customer terminates the service prior to the 12th or 24th month. Those fees are $231.00 per service for Unlimited Plans, and $110.00 per service for 1MB Plans
